Implementation of Restrictive Practices in Disability Support (NDIS)

In line with NDIS (National Disability Insurance Scheme) guidelines, we recognise that while restrictive practices may sometimes be necessary to prevent harm, they must be used ethically, as a last resort, and in the least restrictive way possible.

Restrictive practices are interventions that limit the rights or movement of a person with a disability. These practices must be carefully assessed, monitored, and authorised in compliance with NDIS Quality and Safeguards Commission regulations to ensure they are necessary, proportionate, and aligned with the individual’s needs and best interests.


What Are Restrictive Practices?

Under the NDIS Quality and Safeguards Commission, restrictive practices are defined as any practice or intervention that restricts a person’s rights or freedom of movement. The five regulated restrictive practices include:

  1. Seclusion – Confining a person alone in a space where they cannot leave.
  2. Chemical Restraint – Using medication to influence a person’s behavior rather than for medical treatment.
  3. Mechanical Restraint – Using a device (e.g., straps, mittens) to limit a person’s movement.
  4. Physical Restraint – Using physical force to restrict a person’s movement.
  5. Environmental Restraint – Restricting a person’s access to certain areas or objects (e.g., locked doors, restricted items).

These practices must only be used in exceptional circumstances when all other positive behavior supports have been exhausted, and there is an imminent risk of harm to the individual or others.


NDIS Requirements & Compliance

To ensure the ethical and appropriate use of restrictive practices, the NDIS requires that:

A Positive Behaviour Support Plan (PBSP) is in place – This plan must be developed by a registered NDIS Behaviour Support Practitioner and outline strategies to reduce and eliminate the use of restrictive practices over time.

Authorisation is obtained – Service providers must comply with state and territory laws when using restrictive practices. All practices must be formally authorized where required.

Regular Monitoring & Review – The use of restrictive practices must be documented, reviewed, and assessed to ensure it remains the least restrictive option and aligns with the participant’s evolving needs.

Participant Rights Are Upheld – The least restrictive and most effective approach must always be prioritized, and human rights, dignity, and choice must be respected.

Reporting to the NDIS Commission – Certain restrictive practices are reportable incidents and must be documented and submitted to the NDIS Quality and Safeguards Commission for oversight.
